Actually when couple’s crisis arise it’s an awful scenario for spouses. It’s obvious but, despite those usual opposite views between both of them about of the split, you should consider that legally there are two pretty different types of divorce proceedings: divorce by mutual consent and contentious divorce. 
The divorce under Spanish Law is granted  when the couple have been married for at least three full months, and mutually both spouses apply for it. Divorce in Spain is no-fault, that means is not necessary to cite a reason in order to obtain a divorce.


Advantages for couple are clear when divorce is reached by mutual consent. When both spouses are in agreement about all the terms of the split, the settlement ensures the swiftest way to get easily a divorce.  Some specific items should be fixed: residence, visiting rights, parental responsibility, and maintenance (alimony) for children, use of the former family home; and, if appropriate, compensation pension. 
    It’s better to decide and to fix these terms amicably amid the spouses through settlement: in case of contentious divorce [where there is no agreement], then the Judge decides, and even in a undesirable way for the parties in the procedure. Am I able to obtain a divorce in Spain if I’m a foreigner?

Non-Spanish nationals can get a divorce judgement upon Spanish courts if they are Spanish residents, or if their spouse is a Spanish resident or a Spanish national. Once the divorce is granted, the parties to the marriage can remarry legally. There are some additional technical burdens in case of foreigner divorce, (specific law case study when marriage was made under foreign law, deed legalisation, etc) but it’s tenable in Spain for residents.
